Coverage and exemptions
Building Performance Colorado
Buildings of 50,000 square feet or more of gross floor area must benchmark annually and meet 2030 performance standards.
- Unconditioned storage, parking structures, and aircraft hangars
- Buildings where the majority of floor area is manufacturing or industrial
- Residential buildings with one to three units
- Certain agricultural buildings
- Public buildings benchmark but pay no fees or penalties; the performance standard applies only after a $500,000+ renovation touching 25% or more of floor area

Energize Denver
Denver buildings of 25,000 square feet or more must benchmark annually and meet interim (2028) and final (2032) performance targets for most building types.

Common questions
- When is the Building Performance Colorado report due?
- November 1 each year, starting with the 2026 reporting period. The reporting window opens July 1. Submit through ENERGY STAR Portfolio Manager into BEAM along with the $100 program fee, the $400 Building Decarbonization Enterprise fee, and the progress survey.
- What is the penalty for not benchmarking?
- Up to $577 for a first violation and up to $2,300 for each subsequent violation. CDPHE's Air Pollution Control Division is actively sending notices.
- Is the 2026 interim target enforced?
- No. Owners may track progress instead, and non-compliance obligations do not apply until 2031 for the 2030 standard (C.R.S. 25-7-142(8.6)(b)). Performance penalties can begin January 1, 2030.
- My building is in Denver. Do I file twice?
- Yes. Energize Denver is a separate city ordinance with a June 1 benchmarking deadline and its own targets. Meeting Energize Denver performance requirements satisfies the state performance standard, but the state benchmarking report and fees are still due November 1.
